***FIRST NOTICE: SANDS’ ANNUAL MEETING AND ELECTION OF DIRECTORS
Election of Board members will be held at the annual meeting at Mackle Park on March 10, 2005 at 2:00 p.m. You will be receiving a mailing with more information in January. In the meantime, think about serving on the Board. There will be 4 openings this year, each for a 2-year term and you have until January 28, 2005, to send in your name and a brief resume for mailing with the election ballot. MASTER LOCK SYSTEM
New locks were installed throughout the condo property last year. If for any reason you need to change your lock, you must go to Gulf Island Lock and have the new locks keyed to the master system. All locks must be keyed to the master for fire, emergency and maintenance.
Any other lock is unacceptable and you will be required to change again at your expense.

RULES AND REGULATIONS
Please impress upon your guests the importance of our rules and regulations. We realize they may be on vacation and want to enjoy themselves but their week in the sun in our home comes with responsibilities. The Sands is home to many of us, not a resort.
We cannot emphasize enough the NO DIVING rule. New signs have been painted on the sides of the pool at the command of Collier County. Also if you have an under 12-yr. old who wants to use the spa, there must be a doctor’s letter of permission on file in the office for that child.
The Board will be reviewing the rules around February. If you have any suggestions, please let us know.

TENNIS ANYONE?
If anyone is interested in participating in a weekly Sands Tennis Round Robin, or if you have never played tennis and would like to participate in a group lesson, rackets will be provided. Call Denise Falko B406 @642-0670 or email denisefalko2@aol.com.

WATER CONSERVATION
Water and sewer remains our second largest expenditure behind insurance in the new 2004 budget. We have been advised that new, higher rates will be coming. And for every $1.00 in water, we spend another $1.55 in sewer charges. This may also increase. Please be aware of the water you use.

  1. Turn off the water when you are shaving or brushing your teeth.
  2. Full loads are the most efficient way to run your dishwasher and clothes washer. You also save on soap and electricity.
  3. Look for energy and water saving features on new washers and dishwashers.
  4. Check your showerhead to see if it is a water saving model.

PUBLIC WORKS PROJECTS
Things appear to be coming to a head on three City of Marco Island projects that will impact our property. A special board meeting was held in late September, which included city officials, Tim Richart, and our attorney Rob Samouce. City officials attended to explain the scope of the work to be done, and to request necessary easements.

1. The so-called “outfall project” will get underway in January and last 3-4 months. Work will include replacing and upgrading the existing drainage pipe that has failed with a new 60” pipe that will run along the Sands/Beachview property line, through the San Marco Church rectory property, down Flamingo and out to Landmark Bay. This is the pipe which drains water from our courtyard, which has been designated a water retention area by Collier County. As a result of this meeting, the board voted to grant the city a temporary construction easement to perform this much-needed work. In return, the city has agreed to restore our property to its original condition and replace the ficus trees in the construction area with Magnolia trees. Work will be performed 7:00 a.m. to 7:00 p.m., five days a week.

2. The South Collier Blvd. roadway improvement project is expected to begin in February or March. Major elements include drainage enhancements, placing all utilities underground, sidewalk widening to 8’ on both sides of the street, improved lighting and landscaping, and travel lane adjustments & resurfacing. The entire project will take about 14 months, followed by similar improvements to North Collier Blvd. Generally, work will begin between Maple Ave. and Spruce St., and move north. The right turn lane adjacent to the Sands will be shortened by 120’-150’, and the sidewalk will be widened from 6’, to 8’. To facilitate the sidewalk work, the city has requested a 3’ wide permanent sidewalk easement about 150’ in length along the South Collier Blvd. perimeter of our property. The area in question runs from roughly opposite the entrance to Residents Beach to San Marco Road. The directors approved the request, subject to the City’s agreeing to replace all 6 of the ficus trees on our Collier perimeter with Gumbo-Limbo trees.

3. In conjunction with the South Collier Blvd. project, the city had requested permission to combine our South Collier driveway entrance with Beachview’s, at the city’s expense. Beachview rejected this proposal so it is a dead issue and our drive will remain as is.

Note that the timetables quoted here are subject to change, but owners, renters and guests should expect to experience inconvenience during the construction periods. When all work is completed, our property’s appearance and eye appeal should be significantly improved.

We’re all aware that the ficus trees on our property have caused damage, particularly to adjacent sidewalks and parking areas. Emphasis has been placed on ridding our property of these trees whenever possible. Most recently, Tim Richart obtained a quote of $400-$500 each for their removal. The removal of 6 of these trees by the city will save us approximately $2,500, plus the cost of replacing them with more expensive palms and canopy trees in accordance with standards established by the city.

SCREEN DOORS
Several owners have raised the issue of screen doors. Our rules state if you want to install a screen door, you must get Board approval and install the type of door approved years ago. Some owners do not have screen doors. Some argue that not having a screen door looks as inconsistent as having a different type of screen door, so why can’t I have a door that looks better and is stronger/safer than the approved door. This is an issue we need input from all of the owners. To require all units to have screen doors would require a change in our bylaws. To change the style of door would only require Board approval, but since some owners have just recently installed new doors to comply with the rules, it would not be fair to require them to change it again.

INKJET CARTRIDGE RECYCLING
If you use an inkjet printer and toss your cartridges in the trash, please don’t. If you will give the used cartridges to Tim, The Sands can recycle them for cash. Put them in the replacement cartridge box and drop them through the mail slot if Tim is not in the office, or leave them by the door.

ATTACHED LETTER
In the June 2004 SCOOP we attached a copy of a letter sent by our attorney to a unit owner. This month another letter is attached that was sent by our attorney to another owner. This will continue to be the procedure followed by the Board for owners/families of owners/guests and renters if they ignore our rules and regulations.

SUMMERTIME
For those of you who do not visit The Sands in the summertime, let me give you a hint of what it is like. You can walk into any restaurant without a reservation, unless of course, they are closed for vacation. You can get a tee time when you want and the courses are not crowded and the cost is minimal. Traffic problems are non-existent. Many of the plants and trees we see as just greenery in the winter, blossom beautifully in the summer. Everything is green and lush and in constant need of trimming.
There is some rain almost every day. And it is so very quiet most of the time. As you can guess, I am now a permanent resident at The Sands and enjoying it.

SANDS’ PROPERTY VALUES:
Many of you with e-mail are already aware of the huge increase in property values on Marco Island, and more specifically, The Sands. One 1st floor unit sold for $401,000 and there is a contract for a 2nd floor unit at $425,000. You can be certain that your property taxes will be jumping also. In that vein, it behooves us to keep this property looking the best it can be. Some owners will be getting reminder letters that an item or two may need repairs on the outside of their unit. These same types of letters were sent last year and the response was terrific.

PAINTING:
Beginning in October or maybe earlier, painting contractors will be working on the outsides of the buildings making repairs, scraping old caulking and adding new, power washing, etc., in preparation for painting. The contractors hope to finish all of the painting by December, depending on the weather. So be prepared when you arrive in the fall, that some areas may be roped off to protect your car.

A/C ROOF UNITS: URGENT
The next time you have the A/C checked or serviced, have the serviceman check the roof to insure your roof unit is individually anchored. Our existing cable anchoring system no longer meets new code requirements.

NEW SIGNS:
The April newsletter informed you that Tim was instructed by Collier County Health Department to install or paint NO DIVING signs on the sides of the pool. This has been done and we passed the second inspection with only a few other sign requirements. Still they are being ignored. We must enforce these rules in order to keep our insurance premiums at a level we can afford.

POOL FURNITURE:
Our pool furniture has reached the end of its life span. Since the reserves for the pool furniture were available, the Board has decided to replace the furniture this year. All of the chaise lounges, chairs, tables and umbrellas will be replaced. We will have higher chaise lounges to make it easier to get up. We expect delivery in September or October. If you know of anyone who would like to pick up any of our pool furniture at a very reasonable cost, please let Tim know.

ELEVATION CERTIFICATES:
If any of you have an elevation certificate in your possession, would you be so kind as to make a copy and give it to Tim. We are searching the condo records and have been unable to find one for each building. If you have flood insurance, you may have one. To get new ones, a new survey would have to be done on each building at a cost of $75-$100 per building.

ON STORAGE CLOSETS:
Several owners have personal items stored in the Association storage closets. We need to empty all of them so Tim can store items he must remove from other areas, by order of the Fire Marshall. They will do another inspection soon. If you have any items in any closet, contact Tim immediately so you can tell him what the items are and if he should put them in your unit or dispose of them. All items not claimed will be disposed of by September 15, 2004.

HELP WANTED:
Excellent working conditions but no salary. Building & Grounds/Landscaping Committees need volunteers. Call Tim, please.

OFFICE HOURS REMINDER:

Another beautiful season has ended with most owners returning to their northern homes. We wish you all a good summer and we all look forward to seeing everyone in the fall. Have a great summer!

Speaking of summertime, it has arrived on Marco. Hot days and rainy nights. A reminder if your family members or friends will be arriving to spend vacation time here at The Sands, please make sure they understand that there are rules in place to keep The Sands a great place to visit and more importantly, to live. It is HOME to many of us. We would appreciate their consideration.

There have been a number of complaints about the noise this season, especially concerning washers at late hours. Remember that those below you can hear those washers and loud TV’s.

OFFICE HOURS REMINDER:
Beginning May 15 through October 1, the office will be open from 1:00 - 3:00 in the afternoon if you need to reach Tim. You can also e-mail Tim at tim@thesandsofmarco.com

WATER HEATER REMINDER:
If you have an original water heater, please consult a plumber about replacing it. Most have failed and been replaced but there are still of few of them around. When they fail, they can cause lots of damage to your unit and the one below yours.

INSURANCE INFORMATION:
With a recent change in State law, the unit owner now has to insure their air conditioning condenser on the roof. The Sands has insured them under the condo policies, but it is now the owners’ responsibility. Check with your insurance carrier at renewal. And if your mortgage company is requesting the condo insurance coverage, Tim has a copy of the request form or you may call Cherie Lascano at 305-443-4886 or Jeannie Gallor at 888-746-7673. These are the contact persons at Acordia Southeast, Inc.

CARPETING AND TILE ON LANAIS...
Carpeting installed or glued down over concrete floors can cause STRUCTURAL DAMAGE. No glued down carpeting is allowed on the lanai. If you have loose carpet, please remember to roll it up and store it while you are gone since mold and mildew can form underneath. In the event there is structural damage to any lanai where there is glued down carpet, the Association will not be responsible for repairs.
Owners must also maintain the tile installed on their lanai and this includes making sure the tile is sealed against water leaks and using waterproof grout. If you notice any problem with your lanai tile, ask Tim for an inspection.

****RULES & REGULATIONS...IMPORTANT...PLEASE NOTE...***
All condominium associations have rules and regulations. The Sands is no exception. The rules and regulations are reviewed each year to determine which are no longer needed or required by state, county or city laws. Collier County governs most of our pool/spa rules. Recently, the inspector for Collier County visited The Sands and gave Tim specific rules to change. One includes adding NO DIVING signs to the pool and the signs have been ordered. Another is that no child between the ages of 4-12 will be allowed in the spa unless accompanied by a parent in the spa and without written permission from their physician. If you wish to have your child age 4-12 years in the spa with you, please bring a permission slip to the pool with you. You will be asked to produce it. Absolutely no children under the age of 4 in the spa. This is done for health and safety reasons.

LANDSCAPING IMPROVEMENTS...
The City of Marco Island is moving ahead with the anticipated streetscape and landscape improvements to South Collier Boulevard. The engineering firm hired by the City is preparing preliminary designs for public review and comment. Standards to be recommended are expected to result in some widening of South Collier Boulevard’s travel lanes, medians, turn lanes and sidewalks which, in the aggregate, will extend beyond the City’s current right-of-way. Consequently, some properties (The Sands among them) may be asked by the City for permission to locate some of the planned improvements on their property. Concurrently or shortly thereafter, the City hopes to make similar improvements to the San Marco Road approach to Collier Boulevard, although no encroachment onto our property appears likely at this time. Your Board of Directors views these developments as opportunities to both replace vegetation which has caused serious damage to our property, and enhance the appearance of the outside perimeter of The Sands. The Board has adopted a non-binding resolution to work with the City in drafting landscape improvements that satisfy stringent local Code requirements and improve the appearance of our grounds. In return, the City is expected to share in the cost of new landscaping which directly benefits The Sands.
Representatives of the Buildings & Grounds Committees are in contact with City officials to monitor the status of both projects. Public hearings on this major undertaking, which could take 2-3 years to complete, have been held and will continue until the final plans are drawn. We will provide updates as meaningful developments occur.
